What Happens if I’m Injured at Work?

If a work-related injury happens to you, you may be eligible for benefits under the Virginia Workers’ Compensation Act. You’ll need to follow these steps to help ensure you get the benefits to which you’re entitled:

STEP 1

  • Let your employer know that you’ve been injured in a workplace accident. Report the incident as soon as possible but no later than 30 days from when it occurred. If you don’t, you risk your claim being denied.
  • Your employer should file a report with the Virginia Workers’ Compensation Commission within 10 days.
  • You should also file this Claim for Benefits Form directly with the commission to let them know about your accident. Completing and filing this form also protects your rights. You can file your claim:
    • In-person at any of these locations
    • By mail to Virginia Workers’ Compensation Commission, 333 E. Franklin St., Richmond, VA 23219
    • By fax to 804-823-6956
  • Once you’ve filed your claim, you’ll receive information from the Commission that includes a Jurisdiction Claim Number (JCN) and PIN number for online access to your WebFile account.
  • Your employer may authorize a doctor at the time of your accident. But it’s good practice to tell your provider that you hurt yourself on the job, regardless, especially if the injury needs emergency medical treatment.
  • If your employer or insurance carrier does not respond to your request for medical treatment, contact the Commission for assistance at 1-877-664-2566.

STEP 2

When you schedule an appointment with us at one of our locations in Ashburn, Centreville, Fairfax, and Reston, you may be asked to provide:

  • The date of your injury
  • Your employer’s name and address
  • The insurance carrier’s name and information
  • Your Jurisdiction Claim Number (JCN)

When you come for your appointment, please bring this information along with a photo ID.

STEP 3

Your workers’ comp orthopedic doctor assesses your injury and monitors your progress. They will:

  • Provide the insurance carrier and your employer with details about your treatment and progress
  • Evaluate your disability status, including your readiness and ability to do a job that you did not originally perform
  • If you are released to light-duty work, you must accept all suitable positions offered or risk suspension of benefits. Where appropriate, you may be entitled to retraining.
  • Determine when you will be able to return to work and if you will have any restrictions

How Do You Handle My Workers’ Comp Insurance?

Because we participate in workers’ compensation insurance in Virginia, we’ll coordinate your care and claims with your employer. You just need to report your accident to your employer and file your claim with the Virginia Workers Compensation Commission, as mentioned earlier, to establish your file.

Of course, outside of workers’ comp and work-related injury situations, we accept a large list of insurance plans. If you or a loved one is suffering from an orthopedic issue, or you have an orthopedic problem not related to your work injury, just check with us before your appointment to verify if we accept it.

What Kind of Evaluation Will I Go Through for My Injury?

It’s no different than any other evaluation. You’ll go through a physical exam with your workers’ comp orthopedic doctor, share your family and medical history, and tell us about the injury and the symptoms you’re having. We’ll pay close attention to the type of pain you’re experiencing and its location. We may take X-rays or do an ultrasound, conveniently in-house, to aid in the diagnosis.

After that, we’ll determine which of our surgical and nonsurgical treatment options will work best to reduce the pain, heal the injury, and get you back to business. We’ll also provide physical therapy if needed for your recovery.
